Terms of Service

    1. Acceptance of Terms

    By accessing or using the Motorly platform (motorly.com.au), you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

    2. Our Service

    Motorly is an online platform that connects car owners with licensed dealers across Australia. We provide free vehicle valuations and facilitate the car selling process. Motorly does not buy or sell vehicles directly — we act as an intermediary to match sellers with suitable buyers.

    3. User Responsibilities

    When using Motorly, you agree to:

    • Provide accurate and truthful information about your vehicle
    • Upload genuine photos that accurately represent your vehicle's condition
    • Be the legal owner of the vehicle or have authority to sell it
    • Respond to dealer inquiries in a timely manner
    • Not use the platform for fraudulent or illegal purposes

    4. Valuations & Pricing

    Vehicle valuations provided by Motorly are estimates based on market data and are not guaranteed prices. Final purchase prices are negotiated between you and the purchasing dealer. Motorly is not liable for any difference between the estimated valuation and the final sale price.

    5. Dealer Network

    All dealers in our network are licensed motor vehicle dealers. However, Motorly does not guarantee the conduct of any dealer. Any transaction you enter into with a dealer is between you and the dealer directly.

    Dealers first see your submission as an anonymised listing — vehicle details, condition and location only. Your name, email address, phone number and exact address are not visible to dealers at that stage. A dealer receives your contact details only once they purchase your lead (which happens when you accept their offer, or when a dealer buys the listing at full price).     6. Limitation of Liability

    To the maximum extent permitted by Australian law, Motorly shall not be liable for any indirect, incidental, or consequential damages arising from your use of our platform or any transaction facilitated through our service.

    7. Intellectual Property

    All content on the Motorly platform, including text, graphics, logos, and software, is the property of Motorly and is protected by Australian copyright law. You may not reproduce, distribute, or create derivative works without our written permission.

    8. Changes to Terms

    We may update these Terms of Service from time to time. Continued use of the platform after changes constitutes acceptance of the updated terms.

    9. Australian Consumer Law

    Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded. To the extent any clause in these Terms would otherwise have that effect, it is limited to the maximum extent permitted by law.

    10. Limitation of liability & liability cap

    Subject to section 9, to the maximum extent permitted by law, Motorly's total liability to you arising out of or in connection with your use of the platform, however arising, is limited to AUD $100. This cap does not apply to liability that cannot be limited or excluded under the Australian Consumer Law.

    11. Fees

    Motorly's valuation and lead-matching service is free for sellers — there is no listing fee, commission or sign-up cost to submit a vehicle or receive dealer offers. Motorly is paid by participating dealers, not by sellers.

    12. Termination

    You may stop using Motorly at any time. We may suspend or terminate your access to the platform, or decline to progress a submission, if we reasonably believe you have breached these Terms, provided false information, or used the platform for a fraudulent or unlawful purpose. Sections that by their nature should survive termination (including liability, dispute resolution and governing law) continue to apply.

    13. Dispute resolution

    If you have a complaint or dispute, please contact us first at contact@motorly.com.au so we can try to resolve it directly. If we cannot resolve a dispute within a reasonable time, either party may refer the matter to mediation before commencing court proceedings, without limiting either party's right to seek urgent relief from a court at any time.

    14. Reliance on third-party services

    Motorly's platform relies on third-party infrastructure and services — including Supabase (hosting/database), Resend (email delivery), Google and Microsoft Clarity (analytics), and AI providers used to help generate valuation content. Outages, errors or changes at any of these providers may affect the availability or accuracy of our services, and Motorly is not liable for failures caused by a third-party service outside our reasonable control.

    15. Governing Law

    These terms are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.
